Condiciones generales de contratación

These terms and conditions govern the contractual relationship between you as an event organiser and the JUGENDSTIL HOTEL PAXMONTANA.

1. Scope
These terms and conditions apply for the provision of conference, banqueting and seminar facilities, as well as for all further services and supplies provided by the Jugendstil Hotel Paxmontana associated with this, including the letting of hotel rooms to the event organiser and event participants. The terms and conditions of the Jugendstil Hotel Paxmontana apply exclusively. The terms and conditions of the event organiser do not form part of the contract even where they are not expressly discounted.

2. Reservations
A contract is formed between the event organiser and the Jugendstil Hotel Paxmontana when:
a) an offer from the Jugendstil Hotel Paxmontana is confirmed by the event organiser in writing by return or
b) an enquiry from the event organiser is confirmed in writing by the Jugendstil Hotel Paxmontana.
Changes to the content of the contract are only binding when they are confirmed in writing by the Jugendstil Hotel Paxmontana.

2.1 The acceptance deadline for offers from the Jugendstil Hotel Paxmontana is 30 days where no alternative deadline has been agreed. After this deadline, the Jugendstil Hotel Paxmontana is no longer bound by the offer. The Jugendstil Hotel Paxmontana retains the right to withdraw an offer before the deadline has expired where it has good reason to do so.

3. Changes to participant numbers and event scheduling
The event organiser is obliged to notify the Jugendstil Hotel Paxmontana of changes to the number of participants as early as possible. The Jugendstil Hotel Paxmontana will generally endeavour to assign unutilised reservations elsewhere on the same terms. Where it is able to do so, the event organiser will not be charged.

3.1 The exact number of participants should be notified to the Jugendstil Hotel Paxmontana no later than 7 days before the event. This information forms the basis for invoicing.

3.2 Where the actual number of participants is over 5% less than the confirmed number, the Jugendstil Hotel Paxmontana will charge the following costs for each no-show participant:
- up to 30 days before the event, no costs
- 29 to 8 days before the event, 50% of the agreed services
- 7 or fewer days before the event, 100% of the agreed services

3.3 No later than 20 days before the event, the event organiser will supply the Jugendstil Hotel Paxmontana with a detailed programme, details of spatial arrangements, the type and scope of technical equipment, and all information that the Jugendstil Hotel Paxmontana requires in order to run the event smoothly. Any additional information requested by the Jugendstil Hotel Paxmontana must be provided by the event organiser.

4. Cancellation by the event organiser
Event cancellations must be notified to the Jugendstil Hotel Paxmontana as early as possible in writing.

4.1 If the event is cancelled in its entirety by the event organiser, the Jugendstil Hotel Paxmontana will charge the following cancellation costs:
- up to 60 days before the event, no costs
- 59 to 31 days before the event: 25% of the booked services
- 30 to 11 days before the event: 50% of the booked services
- 10 days to 1 day before the event: 75% of the booked services
- On the day of the event: 100% of the booked services

4.2 Where the booked services have not yet been specified, an amount of CHF 100.00 per person applies as a basic charge.

5. Cancellation by the Jugendstil Hotel Paxmontana
The Jugendstil Hotel Paxmontana reserves the right to withdraw from the contract at any time where it has good reason to do so. Important reasons, in particular, are official constraints and bans, security aspects and cases of force majeure, as well as other circumstances beyond the control or influence of the Jugendstil Hotel Paxmontana. In such cases the Jugendstil Hotel Paxmontana will assist with the organisation of suitable alternative premises.

6. Payment terms
Invoices issued by the Jugendstil Hotel Paxmontana are due in full within 10 days of the invoice date. The invoiced services are to be considered as provided in full and satisfactorily where the event organiser does not lodge a complaint within the period of the payment deadline.

6.1 The Jugendstil Hotel Paxmontana reserves the right to request prepayment of 50% of the agreed services. For bookings with foreign billing addresses or reservations from abroad, prepayment of 100% of the booked services may be required.

6.2 In cases of default, the Jugendstil Hotel Paxmontana reserves the right to charge for costs incurred through overdue notices, address enquiries and credit checks, including those incurred through lawyers’ fees. The event organiser declares himself/herself to be in agreement with the calculation of these costs, even where the law states that these are not, or are only partially, recoverable.

7. Liability
The event organiser is liable for the total invoice amount, including those services received by his/her employees, assistants and event participants. Exemptions must be agreed in writing.

7.1 The Jugendstil Hotel Paxmontana cannot accept any liability for losses or damage to objects brought on site by the event organiser.

8. Final provisions
8.1 All prices are in Swiss francs and include Swiss VAT.
8.2 The Jugendstil Hotel Paxmontana reserves the right to change its prices at any time.
8.3 The place of jurisdiction and execution is Sarnen.
